Our Services include natural language search capabilities, AI-powered wine recommendations, WineRadar analytics, vintage comparisons, pricing data, expert review aggregation, and producer profiles. We aggregate and analyze information from multiple sources to provide users with comprehensive wine knowledge and market intelligence.
We strive to deliver accurate, up-to-date information, but wine data, pricing, and availability are subject to constant change. We may update, modify, expand, or discontinue any aspect of our Services at our sole discretion, without prior notice. Your use of our Services is subject to your full compliance with these Terms.
Intellectual Property and Proprietary Data
All intellectual property rights in and to our Services, including but not limited to our proprietary databases, analytics algorithms, WineRadar metrics, data compilations, software, user interface, design elements, copyrights, trademarks, trade secrets, and any content or data we create or compile, are owned exclusively by CellarCharts or its licensors.
Our proprietary data includes, but is not limited to: our wine database and data compilations; WineRadar analytics and scoring methodologies; price analysis and market intelligence; vintage comparisons and analytics; aggregated review data and consensus scoring; producer profiles and reputation metrics; similarity algorithms and recommendation engines; and any insights, analyses, or derivative works created by CellarCharts.
You acknowledge and agree that you do not acquire any ownership rights, title, or interest in CellarCharts' proprietary data, algorithms, or Services by using our platform.
Third-Party Data and Content
CellarCharts displays certain information from third-party sources, including but not limited to wine critic scores, retail pricing, availability data, and market information. We make reasonable efforts to ensure this data is accurate and properly sourced, but we do not claim ownership of third-party content. Third-party data is provided for informational purposes and is subject to the terms and conditions of the original sources. We reserve the right to add, modify, or remove third-party data at any time.
AI-Generated Content and Recommendations
CellarCharts utilizes artificial intelligence and machine learning technologies to generate wine recommendations, vintage overviews, tasting note summaries, pairing suggestions, and other content. AI-generated content is created based on data analysis, pattern recognition, and algorithmic processing of available information.
While we strive for accuracy, AI-generated content is provided for informational and educational purposes only and should not be considered as professional wine expertise or investment advice. Wine appreciation is subjective, and AI recommendations may not align with your personal preferences. We make no warranties regarding the accuracy, completeness, or suitability of AI-generated content for any particular purpose.
All AI-generated content created by CellarCharts remains our intellectual property. You may use AI-generated content for personal, non-commercial purposes only, subject to the license terms below.
User License and Restrictions
Subject to your compliance with these Terms, CellarCharts grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial purposes.
You expressly agree NOT to:
- Copy, reproduce, download, scrape, crawl, or extract data from CellarCharts using automated means, including but not limited to bots, scrapers, spiders, or any data mining tools or techniques;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms of our Services, WineRadar analytics, or proprietary methodologies;
- Create any derivative database, dataset, or competing service using data obtained from CellarCharts;
- Redistribute, resell, sublicense, or commercially exploit any data, content, or information obtained from CellarCharts;
- Use our Services or data to train artificial intelligence models, machine learning algorithms, or any automated systems without our express written permission;
- Remove, obscure, or alter any proprietary notices, attributions, or watermarks on our Services or content;
- Access our Services through any means other than our provided user interface, except as explicitly authorized through our API program;
- Interfere with, damage, or disrupt our Services, servers, networks, or security measures;
- Use our Services for any unlawful purpose or in violation of any applicable laws or regulations;
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity;
- Circumvent any access restrictions, rate limits, or technological protection measures we implement.
API Access and Enterprise Licensing
CellarCharts may offer API access or enterprise licensing arrangements that permit programmatic access to certain data and functionality. API access and enterprise licenses are subject to separate written agreements and are not granted under these general Terms of Use.
If you are granted API access or an enterprise license, you agree that:
- CellarCharts retains all ownership and intellectual property rights in the data and Services provided through the API;
- You may only use API data for the specific purposes authorized in your API agreement;
- You may not redistribute, resell, or provide API data to third parties without express written permission;
- You may not use API data to create competing wine databases, analytics platforms, or services;
- You must comply with all rate limits, usage restrictions, and technical requirements specified in your API agreement;
- API access may be suspended or terminated immediately for any violation of your API agreement or these Terms;
- You must maintain appropriate security measures to protect API credentials and prevent unauthorized access.
Unauthorized API access or use of automated tools to extract data from CellarCharts constitutes a material breach of these Terms and may result in immediate termination of access and legal action.
Data Export and Personal Use
We may provide limited data export functionality to allow you to save or download certain information for your personal use, such as wine lists, cellar tracking data, or personal notes. Any exported data remains subject to these Terms and may only be used for your personal, non-commercial purposes. You may not aggregate, republish, redistribute, or create derivative works from exported data.
User-Generated Content
Ownership and Licensing: When you submit content to CellarCharts, including wine reviews, tasting notes, photos, cellar inventory data, ratings, or other materials ("User Content"), you retain ownership of your User Content. However, by submitting User Content, you grant CellarCharts a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and transferable license to use, display, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and otherwise exploit your User Content in connection with our Services, including promotional activities, analytics, and machine learning applications.
Usage and Rights: Your User Content may be used by CellarCharts across various platforms, media, and applications, including integration into our AI systems and analytics. You affirm that you have all necessary rights to share your User Content and that it does not infringe upon any third-party rights, including intellectual property, privacy, or publicity rights.
Content Standards: You are solely responsible for your User Content. You agree that your User Content will not contain material that is unlawful, defamatory, obscene, abusive, harassing, fraudulent, or otherwise objectionable. CellarCharts reserves the right to review, moderate, remove, or refuse to publish any User Content at our sole discretion, with or without notice.
No Compensation: You acknowledge that you will not receive any compensation for User Content or for our use of User Content as permitted under these Terms.
User Conduct
You agree not to engage in any of the following prohibited activities while using our Services:
- Violating any applicable local, state, national, or international laws or regulations;
- Infringing upon the intellectual property rights, privacy rights, or other rights of CellarCharts or any third party;
- Using our Services in any manner that could damage, disable, overburden, or impair our servers, networks, or infrastructure;
- Attempting to gain unauthorized access to our Services, databases, systems, networks, or any user accounts;
- Engaging in any form of data scraping, harvesting, or extraction not explicitly authorized by these Terms;
- Posting or transmitting any viruses, malware, or other malicious code;
- Harassing, threatening, or abusing other users;
- Creating multiple accounts to circumvent restrictions or limitations;
- Engaging in any activity that interferes with or disrupts the Services or other users' enjoyment of the Services.
Subscription Services
CellarCharts may offer paid subscription services or premium tiers that provide access to enhanced features, advanced analytics, expanded data sets, API access, or other premium content not available in the standard version of CellarCharts. By subscribing to a paid service, you agree to the following terms:
Subscription Fees and Payment: Subscription fees are charged on a recurring basis as outlined at the time of subscription. You agree to provide current, complete, and accurate payment and account information for all purchases made. We use third-party payment processors to handle transactions securely.
Automatic Renewal: Your subscription will automatically renew at the end of each subscription period unless you cancel before the end of the current period. You will be charged the subscription fee for the next period through your chosen payment method. We will provide advance notice of any price changes.
Cancellation Policy: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle. No refunds will be provided for any remaining portion of the subscription period, except as required by applicable law.
Changes to Subscription Fees: CellarCharts reserves the right to modify subscription fees at any time. We will provide advance notice of any fee changes, and your continued use of the subscription service after such notice constitutes acceptance of the new fees.
Mobile Application
CellarCharts may be accessible via mobile applications available on iOS and Android platforms. These Terms apply equally to your use of CellarCharts via our mobile applications. The use of our mobile applications may be subject to additional terms and conditions imposed by the respective app stores (Apple App Store for iOS and Google Play for Android).
Digital Millennium Copyright Act (DMCA) Compliance
CellarCharts respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.
If you believe that your copyrighted work has been copied or used on CellarCharts in a way that constitutes copyright infringement, please provide our designated Copyright Agent with the following information:
- A physical or electronic signature of the copyright owner or person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material;
- Your contact information, including address, telephone number, and email address;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
DMCA notices should be submitted via our online contact form at cellarcharts.com/contact with the subject line "DMCA Takedown Notice."
Counter-Notification: If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent containing the information required by the DMCA.
Repeat Infringer Policy: CellarCharts will terminate the accounts of users who are repeat infringers of intellectual property rights in appropriate circumstances.
Disclaimer of Warranties
Our Services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, express or implied. CellarCharts expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, reliability, and any warranties arising from course of dealing or usage of trade.
We make no warranty that:
- The Services will meet your requirements or expectations;
- The Services will be uninterrupted, timely, secure, or error-free;
- Any data, pricing information, or analytics provided through the Services will be accurate, complete, current, or reliable;
- Any defects or errors in the Services will be corrected;
- The Services or servers are free of viruses or other harmful components.
Wine pricing, availability, vintage information, and other data displayed on CellarCharts are subject to change without notice and may not reflect real-time accuracy. Wine ratings and scores from critics or publications are third-party opinions and do not constitute endorsements by CellarCharts. You are solely responsible for verifying any information before making purchasing or investment decisions.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CELLARCHARTS, ITS AFFILIATES, LICENSORS, PARTNERS, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities;
- Loss of use or interruption of business;
- Cost of substitute goods or services;
- Damages arising from wine purchases, investments, or decisions based on information from our Services;
- Any other intangible losses;
ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) OUR SERVICES, CONTENT, OR DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO CELLARCHARTS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Indemnification
You agree to indemnify, defend, and hold harmless CellarCharts, its affiliates, licensors, partners, and their respective directors, officers, employees, agents, and representatives from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:
- Your access to or use of our Services;
- Your violation of these Terms;
- Your violation of any applicable laws or regulations;
- Your User Content or any content you submit;
- Your infringement of any intellectual property or other rights of any third party;
- Any unauthorized use of our data, content, or Services;
- Your negligence or willful misconduct.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
Termination
We reserve the right, in our sole discretion, to terminate, suspend, or restrict your access to and use of our Services, in whole or in part, with or without notice, at any time and for any reason, including but not limited to:

- Suspected fraudulent, abusive, or illegal activity;
- Extended periods of inactivity;
- Requests by law enforcement or government agencies;

- Technical or security issues;
- Engagement in data scraping or unauthorized automated access.
Upon termination, all rights and licenses granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution provisions.
You may terminate your account at any time by contacting us or through your account settings. Termination of your account does not relieve you of any obligations incurred prior to termination.
Changes to Services and Terms
We reserve the right to modify, update, suspend, or discontinue any aspect of our Services, including features, functionality, data availability, or access restrictions, at any time without prior notice or liability.
We may modify these Terms from time to time in our sole discretion. Any changes to these Terms will be posted on our website with an updated "Last Updated" date. Material changes will be communicated through prominent notice on our website, email notification, or other appropriate means. Your continued use of our Services after any such modifications constitutes your acceptance of the updated Terms. We encourage you to periodically review these Terms to stay informed of any changes.
Governing Law and Jurisdiction
These Terms and any dispute arising out of or in connection with your use of our Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in California for the resolution of any disputes.
Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in California, and judgment on the arbitration award may be entered in any court having jurisdiction. Each party shall bear its own costs and fees, including attorney's fees, unless the arbitrator awards such costs and fees to the prevailing party.
Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and CellarCharts individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and effectuates the economic intent of these Terms.
No Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of CellarCharts.
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and CellarCharts concerning your use of the Services and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral, with respect to the subject matter hereof.
Assignment
You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign, transfer, or delegate these Terms and our rights and obligations without restriction, including to any affiliate or in connection with any merger, acquisition, reorganization, or sale of assets.
